Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the Vocabulary Builder - Learning mobile application (the "App") operated by PAX Game Studio ("we," "our," or "us").

We reserve the right to modify these Terms at any time. Your continued use of the App following any changes indicates your acceptance of the new Terms.

2. Use of the App

The App is designed to help you learn and expand your English vocabulary through interactive learning features. You agree to use the App only for its intended purpose and in compliance with all applicable laws.

You agree NOT to:

• Use the App for any illegal or unauthorized purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Interfere with or disrupt the App's functionality
• Use automated systems or software to extract data from the App
• Distribute, license, or sell the App or its content without authorization

3. User Accounts

The App does not require account registration. All your learning data is stored locally on your device. You are responsible for maintaining the security of your device and any data stored on it.

4. Premium Subscriptions

The App offers premium features through in-app purchases:

• Monthly Subscription: Recurring monthly payment for premium access
• Yearly Subscription: Recurring yearly payment for premium access at a discounted rate
• Lifetime Access: One-time payment for permanent premium access

4.1 Payment and Billing

• All purchases are processed through Apple App Store or Google Play Store
• Prices are displayed in your local currency and may vary by region
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period

4.2 Cancellation and Refunds

• You can cancel your subscription at any time through your App Store or Google Play account settings
• Cancellation takes effect at the end of the current billing period
• Refunds are handled by Apple or Google according to their respective policies
• Lifetime purchases are non-refundable except as required by applicable law

4.3 Free Trial

If a free trial is offered, you will not be charged during the trial period. At the end of the trial, your subscription will automatically convert to a paid subscription unless canceled.

5. Intellectual Property

All content within the App, including but not limited to:

• Vocabulary words, definitions, and example sentences
• App design, graphics, and user interface
• Audio pronunciations
• Quiz questions and learning algorithms

is the property of PAX Game Studio or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes only.

6. User-Generated Content

The App allows you to create custom word collections and bookmarks. You retain ownership of any content you create, but you grant us a license to use this content solely for the purpose of providing and improving the App's services.

7. Third-Party Services

The App may integrate with third-party services:

• Google AdMob: For displaying advertisements in the free version
• Apple/Google Payment Services: For processing in-app purchases
• Device Text-to-Speech: For word pronunciations

Your use of these services is subject to their respective terms and privacy policies.

8. Disclaimer of Warranties

We do not warrant that:

• The App will be uninterrupted, error-free, or secure
• The vocabulary content will be completely accurate or suitable for your specific learning goals
• Any errors in the App will be corrected

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAX GAME STUDIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of data or learning progress
• Loss of profits or business opportunities
• Device damage or malfunction
• Any other damages arising from your use of the App

Our total liability shall not exceed the amount you paid for the App or premium subscription in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless PAX Game Studio, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

11. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe:

• Violates these Terms
• Is harmful to other users or the App
• Is illegal or fraudulent

Upon termination, your right to use the App will immediately cease. All provisions of these Terms which should survive termination shall survive.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be resolved in the courts of Istanbul, Turkey.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PAX Game Studio regarding the App and supersede all prior agreements and understandings.
